Welcome to Health Intelligence Analyzer. These Terms of Use ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Digital Video Enterprises Inc., a Florida corporation doing business as Health Intelligence Analyzer ("Company," "we," "us," or "our"). By accessing or using our website, mobile applications, or any related services (collectively, the "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must immediately discontinue use of the Platform.

1. Nature of the Service

1.1 Educational and Informational Purpose Only

Health Intelligence Analyzer provides AI-assisted health analysis, educational insights, and research discovery tools. All content, analysis results, risk flags, research briefings, and recommendations generated by the Platform are for general informational and educational purposes only.

1.2 Not Medical Advice

The Platform does NOT provide medical advice, diagnosis, treatment recommendations, or prescriptions. The information provided should never be used as a substitute for professional medical advice, diagnosis, or treatment from a licensed healthcare provider. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition, medication, supplement, or treatment plan.

1.3 No Doctor-Patient Relationship

Use of the Platform does not create a doctor-patient, therapist-patient, or any other healthcare provider-patient relationship between you and Health Intelligence Analyzer.

1.4 Emergency Situations

If you are experiencing a medical emergency, call 911 or your local emergency services immediately. Do not rely on this Platform for emergency medical guidance.

2. Eligibility

To use the Platform, you must:

• Be at least 18 years of age or the age of majority in your jurisdiction;
• Have the legal capacity to enter into binding agreements;
• Provide accurate, current, and complete information during registration;
• Not be prohibited from using the Platform under applicable law.

By creating an account, you represent and warrant that all registration information you submit is truthful, accurate, and complete, and you agree to maintain the accuracy of such information.

3. Account Registration and Security

3.1 Account Creation

Access to certain features requires creating an account with a valid email address and a secure password. You are solely responsible for maintaining the confidentiality of your account credentials.

3.2 Account Responsibility

You are responsible for all activities that occur under your account. You agree to immediately notify Health Intelligence Analyzer of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to protect your account information.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms, is harmful to other users, or is harmful to the business interests of Health Intelligence Analyzer.

4. Subscription Plans, Credits, and Billing

4.1 Service Tiers

The Platform offers the following service tiers:

• Free Tier: Includes 2 AI analysis credits per month, access to health calculators (BMI, calorie), profile management, and saved report viewing. Monthly credits expire at the end of each billing cycle and do not roll over.
• Optimizer Subscription ($9.99/month): Includes 25 AI analysis credits per month, advanced analysis details, and all Free Tier features. Monthly credits expire at the end of each billing cycle.
• Credit Pack ($2.99 one-time): 5 rollover AI analysis credits that do not expire and are consumed after monthly credits are exhausted.

4.2 Payment Processing

All payments are processed through PayPal. By subscribing or purchasing credits, you agree to PayPal's terms of service. Health Intelligence Analyzer does not store your payment card information. All billing disputes related to payment processing should first be addressed through PayPal.

4.3 Recurring Billing

Optimizer Subscriptions are billed on a recurring monthly basis. By subscribing, you authorize Health Intelligence Analyzer to charge the applicable subscription fee to your PayPal account at the beginning of each billing cycle until you cancel.

4.4 Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation, your subscription benefits will continue until the end of the current billing period, after which your account will revert to the Free Tier. Unused monthly credits are forfeited upon cancellation or tier change.

4.5 Refund Policy

Due to the nature of digital services and AI-generated content, all sales are final. Subscription fees and credit pack purchases are non-refundable except as required by applicable law or at the sole discretion of Health Intelligence Analyzer. If you believe a charge was made in error, please contact support through your account dashboard.

4.6 Price Changes

We reserve the right to modify pricing at any time. Existing subscribers will be given at least 30 days' notice before any price increase takes effect on their account.

5. Acceptable Use

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable local, state, national, or international law;
• Submit false, misleading, or fraudulent health information;
• Attempt to reverse-engineer, decompile, disassemble, or otherwise attempt to discover the source code or algorithms of the Platform;
• Use automated scripts, bots, scrapers, or other automated means to access the Platform or extract data;
• Interfere with or disrupt the integrity or performance of the Platform or its underlying infrastructure;
• Attempt to gain unauthorized access to the Platform, other user accounts, or computer systems;
• Share, resell, sublicense, or redistribute your account access or AI analysis credits;
• Use the Platform to generate content that is harmful, threatening, abusive, defamatory, or otherwise objectionable;
• Circumvent any credit limitations, usage restrictions, or access controls.

6. Intellectual Property

6.1 Platform Ownership

All content, features, functionality, software, designs, text, graphics, logos, icons, and the overall arrangement thereof on the Platform are owned by Digital Video Enterprises Inc. and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 AI-Generated Content

Analysis reports, research briefings, risk assessments, and other AI-generated outputs are provided for your personal, non-commercial use only. You may share your own reports for personal health management purposes (e.g., with your healthcare provider) but may not commercially redistribute, publish, or resell AI-generated content.

6.3 User Content

You retain ownership of the health profile data and information you submit to the Platform. By submitting content, you grant Health Intelligence Analyzer a limited, non-exclusive license to process, encrypt, store, and analyze your data solely for the purpose of providing the services described herein.

7. Disclaimers and Limitation of Liability

7.1 Disclaimer of Warranties

THE PLATFORM AND ALL CONTENT, SERVICES, AND FEATURES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

7.2 AI Accuracy

Health Intelligence Analyzer does not warrant that AI-generated analyses, risk flags, research results, or recommendations are accurate, complete, reliable, current, or error-free. AI systems may produce incorrect, incomplete, or outdated information. You acknowledge and accept the inherent limitations of AI technology and assume full responsibility for any decisions made based on Platform outputs.

7.3 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY FLORIDA LAW, IN NO EVENT SHALL DIGITAL VIDEO ENTERPRISES INC. (D/B/A HEALTH INTELLIGENCE ANALYZER), ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE PLATFORM;
• ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE PLATFORM;
• ANY AI-GENERATED CONTENT, ANALYSIS, OR RECOMMENDATION OBTAINED FROM THE PLATFORM;
• ANY HEALTH DECISIONS MADE BASED ON PLATFORM OUTPUTS;
• UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO HEALTH INTELLIGENCE ANALYZER IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).

8. Indemnification

You agree to indemnify, defend, and hold harmless Digital Video Enterprises Inc. (d/b/a Health Intelligence Analyzer) and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any rights of any third party; or (d) any health-related decisions made in reliance on Platform outputs.

9. Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal and health information. By using the Platform, you consent to the practices described in the Privacy Policy.

10. Third-Party Services

The Platform integrates with third-party services including but not limited to PayPal for payment processing and AI service providers for analysis generation. Your use of such third-party services is subject to their respective terms and privacy policies. Health Intelligence Analyzer is not responsible for the practices, content, or availability of third-party services.

11. Modifications to Terms

Health Intelligence Analyzer reserves the right to modify these Terms at any time. Material changes will be communicated by posting the updated Terms on the Platform with a revised "Last Updated" date. Your continued use of the Platform after such modifications constitutes acceptance of the updated Terms. It is your responsibility to review these Terms periodically.

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.

12.2 Jurisdiction and Venue

Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in the State of Florida, and you hereby consent to the personal jurisdiction and venue of such courts.

12.3 Informal Resolution

Before filing any formal legal proceedings, you agree to first attempt to resolve any dispute informally by contacting Health Intelligence Analyzer through the support channel available in your account dashboard. We will attempt to resolve the dispute informally within 30 business days.

13. Technical Support

Technical support and customer service inquiries are handled exclusively through the support messaging system available within your account dashboard after logging in. Health Intelligence Analyzer does not provide support via telephone, social media, or external email. Response times may vary based on inquiry volume and complexity.

14. General Provisions

14.1 Entire Agreement

These Terms, together with the Privacy Policy and Cookie Notice, constitute the entire agreement between you and Health Intelligence Analyzer regarding the use of the Platform.

14.2 Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable Florida law, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

14.3 Waiver

The failure of Health Intelligence Analyzer to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

14.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without the prior written consent of Health Intelligence Analyzer. We may assign our rights and obligations under these Terms without restriction.

14.5 Force Majeure

Health Intelligence Analyzer shall not be liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, internet outages, power failures, or third-party service disruptions.
